For existing licensees:
  • Maximum capacity includes all occupants, i.e. patrons and staff. This is for consistency with other authorities that determine capacity.
For new applicants or existing licensees requiring a new capacity (e.g., renovation, extension of licence):
  • The LGCA will establish maximum capacity based on the maximum capacity set by the municipality or authority having jurisdiction (e.g., Office of the Fire Commissioner). In order for capacity to be based on a calculation of  0.55 m² (6 ft²) of useable space per person or less, the licensee will be required to submit an emergency safety plan to the LGCA for review.   • If the municipality or authority having jurisdiction does not include maximum capacity with their occupancy approval, or if the maximum capacity is not specific to the licensed area(s), the LGCA will establish maximum capacity based on the calculation of 1.2 m² (13 ft²) of usable space per person.
  • For consistency with other authorities that determine maximum capacity, maximum capacities established by the LGCA will include all occupants, i.e. patrons and staff.

This process does not apply if capacity is limited by LGCA terms and conditions.
